· NNJDC 115.342 PREA Placement of Residents in Housing, Bed,
Program, Education, and Work Assignments
· NNJDC Administrative Confinement Guidelines
Interviews Conducted:
· PREA Coordinator
· Director
· Specialized Staff (Supervised Isolation, Medical, and Mental Health
Staff)
NNJDC policy 115.368 provides that any use of segregated housing to protect a
resident who has alleged sexual abuse must comply with the requirements of
§115.342, including limitations on use of isolation and required access to
programming and services. The policy further requires that residents placed in such
status retain access to daily large-muscle exercise and any legally required
education or special education services, and receive daily visits from medical and
mental health staff, with additional access to services as appropriate.
The Director reported that NNJDC would identify alternative protective measures to
ensure resident safety rather than isolation. However, policy provisions are in place
should protective separation be required in an emergent situation.
Medical and mental health staff confirmed that although isolation has not been used
as a protective measure in the past 12 months, they would provide daily monitoring
and clinical check-ins if such a situation were to occur. The nurse and mental health
clinician both indicated they would conduct daily and as-needed assessments to
monitor resident safety and wellbeing.
The Pre-Audit Questionnaire confirmed that no residents who alleged sexual abuse
were placed in isolation during the audit period; therefore, no applicable case files
were available for review.
Compliance Determination:
Based on the evidence reviewed and interviews conducted, the auditor has
determined that NNJDC meets the requirements of this standard. No corrective
action is required.
