grievances. Both cases reached their conclusion within 90 days and no extensions
were needed during this audit period.
Staff confirmed that emergency grievances alleging imminent risk of sexual abuse
are handled immediately, with required notifications made through the chain of
command and documented on a PREA response checklist. There were zero
emergency grievances alleging substantial risk of imminent sexual abuse that were
filed in the past 12 months.
Policy also provides that residents may be subject to disciplinary action if a
grievance is found to be filed in bad faith. However, the facility reported that no
residents were disciplined for filing grievances related to sexual abuse or sexual
harassment during the audit period.
During interviews, staff demonstrated an understanding of the grievance process,
including requirements for immediate safety actions, supervisory notification, and
timely investigation and response. Residents interviewed were generally aware of
grievance procedures and confirmed that they could submit complaints related to
safety concerns, including sexual abuse, through established reporting channels.
Compliance Determination
Based on a review of facility policies, grievance procedures, website information,
staff and resident interviews, and the Pre-Audit Questionnaire, the auditor
determined that NNJDC has an effective administrative remedy process that
provides residents with multiple avenues to file, pursue, and appeal grievances
related to sexual abuse in accordance with PREA requirements.
Accordingly, the auditor finds that NNJDC meets the requirements of Standard
115.352, and no corrective action is required.
