allegations seriously and initiate appropriate investigative responses.
Staff interviews consistently demonstrated an understanding of their obligation to
report all allegations of sexual abuse and sexual harassment immediately. Staff
stated that any such allegation would be taken seriously, reported through proper
channels, and referred for investigation without delay. Staff further acknowledged
their role in ensuring resident safety and maintaining compliance with PREA
reporting requirements.
Interviews with members of the Incident Review Team, the PREA Coordinator, and
the Director confirmed that NNJDC places a high priority on ensuring that all
allegations are fully investigated and resolved. These individuals demonstrated a
clear understanding of the investigative process and the requirement to refer
criminal matters to NNPD and other relevant external agencies.
The auditor also noted that NNJDC has established collaborative working
relationships with the Newport News Police Department, Riverside Regional Medical
Center, the Center for Sexual Assault Survivors (CSAS), and the Virginia Department
of Social Services. These partnerships support the facility’s ability to respond
appropriately to allegations of sexual abuse and sexual harassment and ensure
access to investigative, medical, and advocacy services when needed.
Compliance Determination
Based on a review of facility policies, the Pre-Audit Questionnaire, public PREA
reporting information, site observations, and interviews with the PREA Coordinator,
Assistant Director, staff, and residents, the auditor determined that NNJDC has
established clear procedures for ensuring that all allegations of sexual abuse and
sexual harassment are appropriately referred for investigation.
Although no allegations were reported during the audit period, the facility has
demonstrated appropriate policies, reporting mechanisms, and interagency
coordination to ensure compliance with investigative referral requirements.
Accordingly, the auditor finds that NNJDC meets the requirements of Standard
115.322, and no corrective action is required.
