NNJDC policy 115.363 requires that upon receiving an allegation that a resident was
sexually abused while confined at another facility, the Director shall report the
allegation to the head of that facility and to the appropriate investigative authority,
consistent with applicable reporting requirements. The report must be made as soon
as possible, but no later than 72 hours after receiving the allegation, and all such
notifications must be documented.
The PREA Coordinator reported that there have been no allegations received in the
past 12 months involving residents reporting sexual abuse that occurred at another
facility; therefore, no notifications to external facilities were required during the
audit period. The Director confirmed understanding of the reporting obligation and
indicated that any such allegation would be promptly reported in accordance with
policy and PREA standards.
The Director further confirmed that NNJDC has not received any notifications from
other facilities alleging sexual abuse that occurred at NNJDC during the same
period. Accordingly, there were no related records available for review. The Director
stated that any such notification, if received, would result in an immediate
administrative response and investigation consistent with PREA requirements.
Compliance Determination:
Based on the evidence reviewed and staff interviews, the auditor has determined
that NNJDC meets the requirements of this standard. No corrective action is
required.
