NNJDC Policy 115.386 requires the facility to conduct a sexual abuse incident review
within 30 days of the conclusion of every sexual abuse investigation, including
unsubstantiated allegations, unless the allegation is determined to be unfounded.
The PREA Coordinator confirmed that there were six administrative or criminal
investigations for allegations of sexual abuse conducted during the 12 months
preceding the audit period (three were unfounded); a sexual abuse incident review
was conducted at the conclusion of every investigation and formally documented.
The auditor was provided unfettered access to all sexual abuse investigations and
incident review reports.
The facility utilizes a structured incident review form that documents participation
by members of the review team, which includes the Director, Assistant Director,
PREA Coordinator, Secure Detention Administrator, and input from supervisory,
senior detention, medical, and mental health staff as applicable.
Consistent with Policy 115.386(C), the incident review process requires
consideration of whether:
· Policy or practice changes are needed to prevent future incidents
· The incident was motivated by bias or group dynamics (including race,
gender identity, sexual orientation, or gang affiliation)
· Physical layout contributed to the incident
· Staffing levels were adequate at the time and location
· Monitoring technology should be enhanced or expanded
· Formal findings and recommendations are documented and submitted
to the Director for further review and action
The Director and PREA Coordinator confirmed that all required factors are
considered during the review process when applicable, and the incident review form
reflects these required elements.
