The auditor reviewed the Pre-Audit Questionnaire (PAQ), applicable policies,
memoranda of agreement, evidence protocols, and conducted interviews with
facility staff and community partners to assess compliance with Standard 115.321.
NNJDC Policy 115.322, Policies to Ensure Referrals of Allegations for Investigation,
establishes that the facility conducts administrative investigations into all
allegations of sexual abuse and sexual harassment. The PREA Coordinator is
responsible for overseeing administrative investigations, while allegations that
appear to involve criminal conduct are immediately referred to the Newport News
Police Department (NNPD) Special Victims Unit for criminal investigation. In
accordance with state law and facility policy, allegations involving juvenile victims
are also reported to the Virginia Department of Social Services, Child Protective
Services (CPS).
Policy 115.321, PREA Evidence Protocol and Forensic Medical Examinations, requires
the facility to utilize a uniform evidence protocol designed to maximize the potential
for obtaining usable physical evidence for both administrative proceedings and
criminal prosecutions. The policy is developmentally appropriate for juvenile
residents and is based upon nationally recognized best practices, including the U.S.
Department of Justice's National Protocol for Sexual Assault Medical Forensic
Examinations and the Sexual Assault Response Teams (SART): A Model Protocol for
Virginia. Facility staff explained that evidence collection is conducted only under the
direction of the Newport News Police Department to preserve the integrity of
criminal investigations.
Consistent with Policy 115.321, residents who are victims of sexual abuse are
offered timely access to forensic medical examinations at no financial cost. The
facility utilizes Riverside Regional Medical Center to provide these services. The
policy requires that examinations be performed by a Sexual Assault Forensic
Examiner (SAFE) or Sexual Assault Nurse Examiner (SANE) whenever available. If a
SAFE or SANE is unavailable, examinations may be conducted by another qualified
medical practitioner, with all efforts to obtain a SAFE or SANE documented.
The auditor contacted Riverside Regional Medical Center during the audit, and a
