2. Ordinance Authorizing an Encroachment Agreement with Huntington Ingalls
Incorporated for the 37th Street Garage Pedestrian Bridge
AN ORDINANCE AUTHORIZING AN ENCROACHMENT UPON THE HUNTINGTON
AVENUE AND 38TH STREET RIGHTS-OF-WAY, IN THE CITY OF NEWPORT NEWS,
VIRGINIA, AS MORE PARTICULARLY SET FORTH HEREIN, AND AUTHORIZING THE
CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF NEWPORT NEWS,
VIRGINIA, AND HUNTINGTON INGALLS INCORPORATED.
City Council was requested to adopt an ordinance authorizing an encroachment
upon the City of Newport News right-of-way and to authorize the City Manager
to execute an encroachment agreement between the City of Newport News
and Huntington Ingalls Incorporated (HII) for the construction and maintenance
of the proposed 37th Street garage pedestrian bridge.
The 37th Street garage project will provide parking to support Navy and HII’s
parking needs. The six-story precast concrete parking garage will provide
approximately 3,100 spaces and includes a pedestrian bridge crossing
Huntington Avenue connecting the garage to pedestrian access on 38th Street.
The overall aesthetics of the bridge comply with the design standards outlined
in the City of Newport News Regional Business District Development Manual
and align with the City’s aesthetic and design requirements. The exterior
design has been presented to and approved by HII and the US Navy and was
presented to the City of Newport News on November 15, 2024.
The proposed use is a parking garage to support Navy and HII's parking needs
for the shipyard. The parking garage is situated in an existing parking lot, so the
use of the land has not changed. The proposed structure would provide much
needed parking in the area. A traffic study prepared by Kimley-Horn dated
February 4, 2025, and approved by the City, provided the necessary
recommendations to vehicular traffic and pedestrian traffic to and from the
proposed site.
These improvements include additional vehicular travel lanes on Warwick and
Huntington, new turn lanes and traffic signals, as well as pedestrian
improvements to include sidewalk improvements and a pedestrian bridge from
the 3rd level of the garage to the west side of Huntington at 38th Street.
The pedestrian bridge required by the City approved traffic study, necessitates a
Right-of-Way Encroachment Agreement. The pedestrian bridge will be owned
and maintained privately by HII; it will be on the right-of-way in order to cross
Huntington Avenue above the vehicular traffic. The right-of-way encroachment
will be comprised of the pedestrian bridge walkway and columns above ground
and foundations underground.
