City of Newport News Chesapeake Bay TMDL Action Plan (2024-2029 MS4 Permit Cycle) 1. Background 1.1 Purpose Section I.A.6 of the City of Newport News’ Municipal Separate Storm Sewer System (MS4) Permit Number VA0088641 requires the City to maintain an updated MS4 Program Plan that includes an updated Chesapeake Bay Total Maximum Daily Load (TMDL) Action Plan. Section I.D. outlines the procedures and required content of the plan. This document serves as the City’s updated Chesapeake Bay TMDL Action Plan for the 2024-2029 MS4 Permit Cycle. 1.2 Introduction The City of Newport News was required to submit a First Cycle Chesapeake Bay TMDL Action Plan to DEQ by June 30, 2018, to demonstrate how it would reduce Total Nitrogen, Total Phosphorus, and Total Suspended Solids by 5.75% during the first permit term (July 1, 2016, through June 30, 2021). The first permit term was to be part of a three-cycle phased approach towards meeting the Chesapeake Bay TMDL requirements. A Draft Second Cycle Chesapeake Bay TMDL Action Plan was submitted December 30, 2020, to demonstrate how the City of Newport News would reduce pollutants by at least 35% (40% cumulatively) during the second MS4 Permit term, which was expected to begin after the first MS4 Permit expired on June 30, 2021. Despite an expired permit, the City continued to construct water quality projects towards meeting nutrient and sediment reduction requirements. The expectation was that a third and final action plan would be submitted to demonstrate a cumulative 100% reduction in pollutants in conjunction with a third permit cycle. The MS4 Permit was reissued with permit effective dates of January 23, 2024, through January 22, 2029. The City is now required to reduce the loads of Total Nitrogen and Total Phosphorous by at least 40%, cumulatively, by June 30, 2026, and by 100%, cumulatively, by June 30, 2028. Total Suspended Solids have been removed from the MS4 Permit as a pollutant of concern (POC). This document serves as the updated Chesapeake Bay TMDL Action Plan that must be submitted to DEQ by January 22, 2025, to address this expedited compliance schedule. 2. Required Reductions The MS4 Permit requires that the City of Newport News reduce the load of Total Nitrogen and Total Phosphorus from existing sources of development (defined as pervious and impervious urban land uses within the MS4 Service Area as of June 30, 2009) by at least 40% by June 30, 2026, and by 100% by June 30, 2028. Further, the permit requires that by June 30, 2028, the City must offset 100% of the increased loads from new sources of development (defined as development and redevelopment projects initiated between July 1, 2009 and June 30, 2024) and from grandfathered projects. The MS4 service area acreage as of June 30, 2009, serves as the basis for calculating the POC reductions that are necessary. Table 2-1 below provides the City’s total area in acres, excluded (non-regulated) categories and their respective acreage, and remaining regulated impervious and pervious acreage. 3
