Official social-media state action
Under Lindke v. Freed, an official’s social-media activity is state action when the official possesses actual authority to speak for government on the matter and purports to exercise that authority in the relevant posts. An account’s appearance alone does not establish the required authority. Applying the framework requires attention to the posts and the challenged restriction.
Supreme Court decision March 15, 2024. Any earlier conduct or damages claim requires separate event-date and qualified-immunity analysis. No Newport News account or action is adjudged here.
