Records custody and routing
When requested records cannot be found or do not exist, Virginia Code § 2.2-3704(B)(3) requires the response to include contact information for another public body known to hold them. It generally does not require creation of a new record. Sending records elsewhere for storage does not, by itself, end the originating body’s responsibility to retrieve and supply them.
Current law reviewed October 12, 2026. Request-specific deadlines still depend on the complete correspondence.
