VOLUNTARY DISCLOSURE
PORT WARWICK FOUNDATION GRANT AGREEMENT
I, Marlin McDaniel, Innovation Program Manager for the City of Newport News, provide this
voluntary disclosure pursuant to the Virginia Conflict of Interests Act:
1.
2.
Iam a member of the Port Warwick Foundation Board of Directors, for which I receive no
remuneration;
On December 9, 2025, the Newport News City Council voted to authorize an agreement
between the City of Newport News, Virginia, and the Port Warwick Foundation, dated
December 9, 2025, concerning an event to be held on Memorial Day Weekend, 2026 (the
“transaction”);
Iam not a member of the Newport News City Council, and as such did not vote to authorize
the transaction on behalf of the City;
I am advised by the City Attorney that the definition of “personal interest in a transaction”
means a personal interest of an officer or employee in any matter considered by his agency;
I am further advised that as I am not a member of City Council, which is the agency
considering the transaction, I have no personal interest in the transaction;
Nevertheless, in the interest of transparency, I am making this voluntary disclosure, as I
provide services to the Port Warwick Foundation, which is a business affected by the
transaction; and
My relationship with the Port Warwick Foundation does not impair my independent
judgment or my ability to act fairly, objectively, and in the public interest in my role as an
employee of the City of Newport News.
This voluntary disclosure shall be kept on file with the City Clerk for a period of five years.
