[Requester salutation redacted]
You were temporarily banned from all Newport News Public Schools (NNPS) property
due to your disruptive behavior on NNPS property on two (2) separate occasions. In this
regard, Federal Courts have long determined that like private property owners, School
Districts may legally preserve the property under its control and that members of the
public do not have a constitutional right to access such property. Courts have further
held that as a general matter, the right to direct the upbringing and education of one's
child does not include unfettered access to school property and that school personnel
have the authority and responsibility for assuring that parents and third parties conduct
themselves appropriately while on school property.
As to the administrative review of your temporary ten (10) day ban from all NNPS
property, such review is not open to the public. Again, Federal Courts have determined
that the public is not free to walk into a school and enter a meeting of educators and that
even parents, apart from the general public, have no constitutional right to attend a
meeting to which they were not invited. Nevertheless, you will be notified in writing
regarding the results of the administrative review of your ten (10) day ban.
Sincerely,
Lynn A. Spratley

Office of the City Attorney
