Legacy Landing: financing conditions and project milestones

Follow the financing requirements, extensions and documented progress toward closing.

Overview

Review the Legacy Landing financing decision and milestone schedule. Identify the operative conditions and later approvals, financing commitments or extensions.

Source notes

Board authorization, a funding commitment, document execution, disbursement, financing conversion and construction acceptance are separate steps. An extension or forbearance label does not by itself establish default. Staff progress reports do not establish final acceptance. Operative deadlines and closing status require executed agreements and closing records.

Timeline

Dates follow the cited records; document dates are labeled separately.

  1. November 2022 financing described in August 2026

    Resolution recounts the construction financing

The August resolution describes an approximately $16.3 million JPMorgan Chase construction loan funded through NNRHA tax-exempt bonds and a Sentara construction-to-permanent loan of up to $6,005,028 for the 84-unit IV-R project. These are financing amounts recited in a later resolution, not verified disbursements or a total project cost.

  2. August 2026 staff report

IV-R enters the reported final punch-list phase

Staff reported IV-R construction at 99%, infrastructure at 94%, the wellness trail at 96% and retail at 100%. These are separate reported work categories. The report places IV-R in its final punch-list phase; the percentages do not establish final acceptance or financing conversion.

  3. August 18, 2026 resolution packet

Permanent funding commitments and lien changes are described

The resolution says DHCD committed three permanent loans through NNRHA to the project owner: $700,000 from the Virginia Housing Trust Fund, $2 million through HIEE and $2 million from the National Housing Trust Fund. It says the Sentara loan would become permanent and move to first-lien position upon conversion. The resolution does not establish that these funds were disbursed or the lien change completed.

  4. August 18, 2026 financing materials

    The proposed conversion deadlines differ

The staff memorandum gives November 29, 2026 for the completion and conversion extension; the attached resolution gives December 31, 2026, and contemplates further time needed to effect conversion. The August minutes included in the September packet repeat November 29. The executed amendment and any later extensions are needed to establish the operative deadline.

  5. August 18, 2026 action recorded in September packet

Minutes record approval to execute financing documents

The August minutes included for approval in the September packet record a unanimous vote authorizing the permanent-financing and bond-loan-forbearance resolution. The proposed resolution permits execution of loan amendments, conversion and extension documents, DHCD loan instruments and related lien and operating-agreement documents. This records reported board authorization; it does not establish execution, permanent closing or disbursement. The reviewed minutes are unsigned and were presented for approval.

  6. September 2026 staff report

Reported construction progress still includes unfinished work

Staff reported IV-R at 100% while still in the final punch-list phase, infrastructure and the wellness trail each at 96%, and retail at 100%. Stormwater CCTV work was nearing completion; the contractor was addressing City comments on sanitary-sewer as-builts; playground corrections were scheduled; irrigation punch-list work was complete. This documents reported site progress, not final acceptance or satisfaction of financing conditions.
