James River Strand: default and completion contract

Review the contractor-default response, completion award, price and final acceptance.

Overview

Trace the project’s default and surety process through contractor selection and the completion agreement. Review change orders, payments and final acceptance separately from campaign finance.

Source notes

The reviewed records establish published City status entries, not the complete procurement, default or accounting file. Listing dates are not necessarily execution or payment dates. Scheduled finish and closeout dates do not establish physical completion or acceptance. The contract-table rows have not been reconciled into a final project cost. No favoritism, improper selection or other misconduct finding is established. These records questions are prepared; no request submission or substantive response is established by this case file.

Timeline

Dates follow the cited records; document dates are labeled separately.

  1. June 28, 2022 work session

Engineering reports the original construction award

City engineering reported a $4,944,000 award to Carolina Marine Structures for park improvements, a multi-use waterfront connection, lighting and shoreline stabilization. The minutes list a July 6, 2022 notice to proceed and October 2, 2023 final completion. Those dates were prospective; the minutes are not the executed contract or evidence of actual completion.

  2. November 4, 2025–July 12, 2026 listed hold

City attributes a construction hold to contractor default

The schedule labels this period a construction hold due to contractor default. That is the City’s published description. The default notice, cure history, termination decision and any surety response have not been established by the reviewed records.

  3. March 25–April 24, 2026 listed period

Interim erosion-control repairs appear in the contract table

The City lists Erosion & Sediment Control Repairs under Newport News - Engineering, with $35,000 in both the contract-amount and paid-to-date columns. The entry does not identify a separate vendor or supply payment vouchers.

  4. July 13, 2026 start listed

A later completion contract appears under Provost

The project page lists Provost Construction & Sons LLC for a $2,252,509.54 completion contract, with a July 13 start and January 8, 2027 finish. These listing dates do not establish the award decision, selection method, executed agreement or actual completion.

  5. October 9, 2026 project comment

    City describes continuing site work

The latest reviewed comment describes planter-box masonry, electrical installation and amphitheater grading. This is a dated staff progress report, not a substantial-completion certificate or final acceptance.

  6. October 11, 2026 webpage observation

Reported payments and damages row need reconciliation

The completion row shows $1,016,540.27 paid to date; this displayed amount has not been verified against a payment ledger. The original-contractor row displays $6,628,412.97 as its contract amount and $4,216,290.33 paid. A separate Liquidated Damages row displays $1,684,412.97 and repeats $4,216,290.33 paid. These entries cannot establish a combined project cost, duplicate payment or damages actually assessed or recovered.

  7. October 11, 2026 webpage observation

Construction and closeout remain separately listed

The schedule shows 90% for overall construction and 50% for the later construction phase, without explaining the measurement basis. Construction closeout is scheduled for January 9–April 8, 2027, followed by project closeout through July 11, 2027. The percentages and future dates do not establish physical completion or acceptance.
